Alec Baldwin Lawsuit Against Prosecutors Dismissed in ‘Rust’ Shooting Case

A significant legal development has emerged from the tragic 2021 “Rust” movie set shooting, as actor Alec Baldwin’s civil lawsuit against New Mexico prosecutors was recently dismissed by a judge. This ruling marks another pivotal moment in the complex legal aftermath surrounding the fatal incident, continuing to draw national attention and public discourse.

Baldwin’s lawsuit, filed earlier in January, leveled serious accusations against several officials, including special prosecutor Kari Morrissey and New Mexico District 1 Attorney Mary Carmack‑Altwies. The actor contended that these individuals, alongside county investigators and the local board of commissioners, had engaged in a conspiracy to fabricate criminal charges against him for personal or political gain, a claim that underscores the contentious nature of the legal proceedings.

This civil action followed the earlier dismissal of Baldwin’s involuntary manslaughter charge in July 2024, a decision prompted by the trial judge’s finding that prosecutors had deliberately withheld crucial evidence from the defense. Such a judicial rebuke highlights the procedural challenges and intense scrutiny that have characterized the “Rust movie” investigation and subsequent legal battles from their inception.

Responding to the latest dismissal, Baldwin’s attorney, Luke Nikas, characterized the event as a “non-event,” indicating that the court’s decision was made without prejudice. He further revealed that the parties have been engaged in good-faith settlement discussions, with the intent to promptly refile the lawsuit if these negotiations do not lead to a favorable resolution, suggesting the legal saga of the “fatal shooting” is far from over.

Despite these developments, the family of cinematographer Halyna Hutchins continues to pursue a wrongful-death claim against Baldwin and other “Rust” producers within the New Mexico state court system. This separate action underscores the multi-faceted legal challenges stemming from the incident, with a deposition for Baldwin still pending rescheduling since its delay in May.

The tragic event itself unfolded on October 21, 2021, during rehearsals for the Western film at Bonanza Creek Ranch near Santa Fe, New Mexico. During a cross-draw maneuver with a Colt .45 revolver, the firearm discharged, resulting in the fatal injury of Hutchins and also wounding director Joel Souza. Investigations subsequently confirmed that live ammunition, which should never have been present on a film set, was mistakenly loaded into the weapon, a critical detail in understanding the “Rust shooting” tragedy.
