DOJ Demands UPMC Records on Trans Youth Gender-Affirming Care

The Department of Justice has escalated its scrutiny of gender-affirming care across the nation, recently issuing a subpoena to UPMC, a major Pittsburgh-based health system, demanding comprehensive records pertaining to its services for transgender youth.

This directive places UPMC among more than 20 medical professionals and clinics nationwide that have received similar subpoenas earlier this month, all seeking detailed information about providers involved in delivering transgender medical procedures to minors.

The actions by the Department of Justice underscore a broader, intensifying campaign initiated by the Trump administration to significantly restrict access to gender-affirming care nationwide, signaling a clear intent to pursue legal and punitive measures against medical providers.

Federal entities have consistently worked to sever federal funding for hospitals and clinics that offer gender-affirming treatments to young patients, with some officials even asserting that certain gender-affirming surgeries could be classified under “female genital mutilation,” an illegal practice.

In response to this mounting pressure, UPMC has affirmed its commitment to continue providing essential behavioral health support and “other necessary care” to its patients, even as it navigates the complex landscape of complying with the administration’s stringent stance on gender-affirming healthcare.

Despite the extensive nature of the investigation, DOJ officials have yet to release a public list of the specific doctors and clinics under scrutiny, nor have they clearly defined what constitutes “transgender medical services,” though they indicate the inquiry spans areas like healthcare fraud and false statements.

Internal communications from UPMC’s legal department reveal detailed instructions for staff to preserve a wide array of documents, including patient identities, diagnoses, informed consent forms, parental authorizations, risk disclosures, adverse event records, and billing and insurance claims, suggesting a comprehensive approach to compliance that may exceed the explicit subpoena requirements.

While the specific details of the subpoena remain undisclosed by UPMC, the health system has acknowledged the profound challenges posed by this investigation and conveyed deep empathy for the patients whose access to vital gender-affirming care may now face significant new obstacles.
