Columbia Sportswear Sues University Over Merchandise Trademark Dispute

A high-stakes legal battle has erupted between two prominent entities sharing a common name: Columbia Sportswear and Columbia University. The outerwear giant has initiated a lawsuit against the esteemed Ivy League institution, alleging significant trademark infringement and a breach of a prior contractual agreement concerning the university’s merchandise. This dispute centers on claims that the university’s apparel line is creating widespread consumer confusion and diluting the established brand identity of Columbia Sportswear.

According to the lawsuit, Columbia Sportswear contends that the university’s clothing and accessories have fostered an environment of “deception” and “confusion” among shoppers. The core of their argument lies in the alleged “misappropriation and misuse of the Columbia name” by the university, which they assert has led to a blurring of lines between the athletic gear producer and the academic institution in the marketplace.

The roots of this legal contention trace back to an agreement signed on June 13, 2023. This pact specifically outlined the permissible ways Columbia University could incorporate the word “Columbia” on its branded apparel and accessories. It stipulated that the name must be accompanied by a recognizable school insignia, its mascot, the explicit word “university,” the name of an academic department, or the university’s founding year, 1754, or a combination thereof, to ensure clear distinction.

However, Columbia Sportswear alleges that the university violated this crucial agreement just over a year later. The Portland, Oregon-based company claims to have discovered multiple garments being sold through the Columbia University online store that conspicuously lacked any of the stipulated distinguishing school logos or features. Furthermore, many of these contested garments reportedly feature a bright blue color palette, which the lawsuit describes as “confusingly similar” to the blue hues long associated with Columbia Sportswear’s established branding.

The lawsuit underscores the severe impact of these alleged infringements, stating that the “likelihood of deception, confusion, and mistake engendered by the university’s misappropriation and misuse of the Columbia name is causing irreparable harm.” Columbia Sportswear asserts that this situation directly jeopardizes the brand integrity, goodwill, and reputation for quality that its registered “Columbia” mark embodies, highlighting the profound commercial implications of the alleged trademark violations.

Filed on July 23 in the U.S. District Court for the District of Oregon, the litigation seeks to rectify these alleged breaches. Columbia Sportswear, a company with a heritage dating back to 1938, emphasizes the intentional nature of the university’s actions in allegedly violating the detailed 2023 agreement, reinforcing the seriousness of the trademark and contract dispute at hand.

As a remedy, Columbia Sportswear is demanding a comprehensive cessation of all sales of clothing that violate the agreement. The company is also seeking the recall of any products already sold and proposes that any remaining merchandise be donated to charity. Beyond injunctive relief, the lawsuit includes a significant financial claim, with Columbia Sportswear requesting a punitive award of three times the amount of actual damages as determined by a jury, underscoring the severity of the alleged harm.
