Announced by the Centers for Medicare and Medicaid Services in June, this new directive fundamentally reclassifies DACA recipients as not “lawfully present,” thereby disqualifying them from Affordable Care Act benefits, a change that will take effect on August 31st and directly countermands a previous Biden-era rule established in November last year that had for the first time enabled many DACA recipients to enroll, underscoring a critical shift in immigration policy.

Jessica Altman, executive director of Covered California, the state’s ACA marketplace, voiced strong disapproval, stating the decision is “deeply unfair” to “hard-working, tax-paying individuals” who had placed their trust in securing health insurance access for 2025, only to have it abruptly rescinded merely eight months later, leaving many vulnerable without essential medical protection and highlighting the immediate impacts of this healthcare reform setback.

Despite over 150,000 DACA recipients residing in California, only approximately 2,300 had successfully enrolled in the ACA since their eligibility was granted, a low number Altman attributes to “broader uncertainty about whether this expansion would stand,” hindering efforts to build trust and expand outreach effectively during the brief window of opportunity for Dreamers healthcare enrollment.

In response to this significant policy setback, Covered California has initiated comprehensive efforts to inform every affected DACA recipient about the change, working collaboratively with community organizations like SIREN, a non-profit offering legal services, to identify and facilitate alternative healthcare coverage options, acknowledging fears from experts like Mariam Arif that many might tragically “fall through the cracks” without continued health insurance access.

Arif, communication director for SIREN, emphasized the severe implications, warning that “losing access to ACA coverage would force many DACA recipients to go without essential health care or pay out-of-pocket costs they simply cannot afford,” highlighting that critical access to care has never been more vital for a demographic including gig economy workers, early retirees, and part-time employees who previously relied on these Affordable Care Act benefits.

Both Altman and Arif expressed apprehension about potential broader governmental rollbacks, with Altman specifically pointing to upcoming federal budget policies slated for 2027 that threaten to defund support for several “lawful immigrant groups,” including refugees, asylees, and humanitarian parolees, signifying a worrying trend for comprehensive immigration policy and social support programs affecting various communities.
